Gisborne.Registered Vol. 3, D, No. 1920, 9th December, 1859.John Poynter,Registrar of Deeds.This deed, made the sixteenth day of December, in the year of our Lord one thousand eight hundred and fifty-eight, between Alfred Domett, of the town of Nelson, in the Province of Nelson, in the Colony of New Zealand, gentleman, John Poynter, of the town of Nelson aforesaid, gentleman, and Thomas Brunner, also of the said town of Nelson, surveyor, Commissioners of Native Reserves, appointed under an Act of the General Assembly of New Zealand, intituled "The Native Reserves Act, one thousand eight hundred and fifty-six," and hereinafter called the Commissioners of the one part, and Charles Thorp of Motueka, in the said Province, Esquire, of the other part; whereas power is given to Commissioners appointe under the said Act (subject to the provisions thereof), to exchange, absolutely sell, lease, or otherwise dispose of lands over which the Native Title shall have been extinguished within the jurisdiction of the said Commissioners respectively, and reserved or set apart for the benefit of the Aboriginal inhabitants; And whereas the land firstly hereinafter described has been set apart for the benefit of the Aboriginal inhabitants, and the Native Title over the same has been extinguished. And whereas the said Commissioners have agreed to exchange the said land with the said Charles Thorp for the land secondly hereinafter described. Now This Deed Witnesseth that in pursuance and in exercise of the powers in them vested, and in consideration of the land conveyed to them in exchange by this deed, the said Commissioners do, and each of them doth hereby convey and assure unto the said Charles Thorp and his heirs, all that piece or parcel of land situated in the district of Motueks aforesaid, containing ninety acres, more or less; being the whole of accommodation section numbered 142, on the plan of the said district, and part of accommodation section numbered 143, on the said plan, bounded on the north by section numbered 141 on the said plan; on the east, partly by the beach road and partly by other part of the said section numbered 134 on the said plan; on the south, partly by park of the said section numbered 143 on the plan and partly by a public road; and on the west by a public road, and which said piece or parcel of land is more particulary delineated and described in the plan drawn in the margin of these presents, and thereon page 394coloured pink, together with the appurtenances thereunto belonging or appertaining, to hold unto and to the use of the said Charles Thorp, his heirs and assigns for ever. And this deed witnesseth that in consideration of the land hereinbefore conveyed unto him in exchange, he, the said Charles Thorp, doth hereby convey and assure unto the said Commissioners, all that piece or parcel of land situated in the district of Motueka aforesaid, containing ninety acres, more or less, being part of accommodation section numbered 165, on the plan of the said district, bounded on the north by sections numbered respectively 164 and 181; on the said plan; on the east, partly by a public road, and partly by other part of the said section numbered 165 on the said plan; on the south, partly by part of the said section numbered 165 on the said plan and partly by a public road; and on the west by public road, and which said last mentioned piece or parcel of land is more particularly delineated and described in this plan drawn in the margin of these presents, and thereon coloured blue, together with the appurtenances thereunto belonging or appertaining, to hold unto the said Commissioners and the survivors or survivor of them, their successors and assigns, upon trust, for the benefit of the Aboriginal inhabitants for whose benefit the and hereinbefore conveyed to the said Charles Thorp in exchange, was set apart or reserved and held. In witness whereof the said parties to these presents have hereunto subscribed their names, the day and year first above written.
